1.GENERAL TERMS AND CONDITIONS
​
These General Terms and Conditions apply to the contract for the use of the CA Group GmbH - Perla Venue hall. Deviating conditions of the contracting party shall not apply, even if the contracting party submits to these conditions. For public events (balls, concerts, performances, theater plays, etc.), the Upper Austrian Event Safety Act and its ordinance (VSVO) must be observed.

2. NUMBER OF VISITORS
​
The organizer acknowledges that the maximum number of visitors specified in the annex (Annex./1) shall apply, and undertakes not to issue tickets for more than that number, in accordance with the Event Police Regulation.
3. LIABILITY
​
The organizer shall not be liable for any (consequential) damages caused by the organizer or the visitors and guests of the event, including all preparatory, construction, execution, and dismantling works for which the organizer is solely responsible. In any case, the organizer shall be liable for all damages caused by construction, inventory, equipment, all repair costs, and, in particular, any other disregard of conditions or house rules.
Multiple organizers shall be jointly and severally liable. The technical facilities of Perla Venue are state-of-the-art and regularly and professionally maintained. Perla Venue shall not be held responsible for technical defects, interruptions, or disruptions in energy or water supply. Perla Venue shall only be liable for damages to property and personal injury caused intentionally or through gross negligence by Perla Venue, its employees, or third parties commissioned by Perla Venue. Compensation for lost profit or any other consequential damages is excluded.
4. INSURANCE

The mandatory organizer's liability insurance (liability, property, and personal insurance) will be automatically concluded through Perla Venue and invoiced to the organizer.
5. CONFIRMATION OF OFFER/VALIDITY
​
The dates and conditions of the event are guaranteed only after a written order has been issued or the signed contract documents have been returned and the deposit has been paid.

6. REMUNERATION AND PAYMENT TERMS
​
The agreed remuneration includes all services included in the offer of Perla Venue. Additional services will be invoiced separately. All fees are subject to value-added tax (VAT).
a. Down Payment/Deposit
A down payment of 30% of the total price is to be paid upon conclusion of the contract. If the deposit is not paid within 8 days after the conclusion of the contract, the contract shall become void and null.
b. Hall Rental
The agreed hall rental fee must be paid in full seven days before the event to the account specified by Perla Venue.
c. Other Costs
Other costs such as technical, labor, and final cleaning will be invoiced separately after the event has been carried out.
7. RIGHT OF WITHDRAWAL AND CANCELLATION CONDITIONS

a. Cancellation by Perla Venue
Perla Venue has the right to cancel if the organizer fails to settle their outstanding obligations according to points 6.a and 6.b in a timely manner. (1.) Furthermore, Perla Venue may terminate the contract if the organizer violates the general terms and conditions. (2.) if the organizer fails to submit the necessary permits to the authorities in a timely manner or if the event is prohibited by the authorities; (3.) if the event violates contractual and legal obligations or the standards of Perla Venue; (4.) if it violates legal provisions; (5.) If the organizer becomes insolvent, and therefore the cancellation conditions specified in point 7.b apply.
b. Cancellation Conditions/Cancellation by the Organizer
The organizer can terminate the hall rental contract without stating reasons. In case of cancellation after the contract has been concluded, cancellation fees apply: equivalent to the deposit. In the event of a cancellation made up to six months prior to the event, we will promptly initiate a refund.

8. HALL USAGE
​
The start of hall usage is determined in the rental agreement. Any planned usage before this time can only be done with the approval of the management of Perla Venue and upon payment of a separately agreed fee.
9.REGISTRATION
​
The organizer is responsible for registering public events with the municipal administration of Linz, District Office, Hauptstraße 1-5, 4040 Linz, Tel.: 0732/7070-2467. Follow the instructions provided by this authority. The organizers must also obtain all other necessary official permits required for the event, part of the event, or specific program items. Local event permits and other permissions for each event or specific parts or program items must be fully implemented and presented to Perla Venue upon request. In the event of an epidemic or pandemic, a legally required hygiene concept must also be presented.
According to § 4 Abs. 3 VerwStV., both the organizer and the owner of the premises used for the event are required to register. If the organizer fails to register with the authorities and is penalized, the organizer is obligated to pay the fine and compensate Perla Venue for all associated costs, expenses, and fees.
For musical performances using audio and visual recordings of any kind, reproduction rights must be obtained from AKM (Austrian Collecting Society for Mechanical Rights). Contracting parties are legally obliged to apply for AKM-related permits well in advance of the event. Failure to do so may result in copyright infringement claims.
10. SECURITY SERVICES AND CLEANING
​
For public events and large-scale events with over 300 people, security services will be organized and billed directly to the organizer. According to § 2 Z 6 Ordnerdienst of the Upper Austrian Event Safety Act (VSVO), there should be at least one usher per 100 expected event attendees, 7 or more for ball games, and 9 or more for school balls. During public events, all entrances and exits must remain unlocked and secured by security personnel from the entry of spectators until the end of the event. Balls and other large-scale events with more than 100 participants must have mandatory cleaning personnel for toilet facilities, which will be invoiced directly to the organizer.
11.DECORATION AND FIRE SAFETY
​
The decoration of event spaces and exterior coverings must be at least Class B1 or Class Q1 according to ÖNORM B 3800 or an equivalent standard. It is strictly prohibited to use open flames or fire. An exemption may be granted if justified by a fire watch organized by a professional association. The use of fog machines and pyrotechnic effects requires prior approval from Perla Venue due to the automatic smoke detection system.
12. TOBACCO AND NON-SMOKING LAW
You must comply with the provisions of the Tobacco and Non-Smokers Protection Act (TNRSG). The TNRSG prohibits smoking in public buildings, including Perla Venue. This prohibition also includes e-cigarettes. Smoking is only allowed in designated outdoor areas. Doors to these areas must always remain closed. Violation of this policy will hold Perla Venue and all personnel harmless from any damages or claims.
13. OFFICIAL PERMITS

The organizer must obtain all necessary permits and authorizations for their event at their own expense and submit them to Perla Venue before the start of the event. Organizers must promptly comply with any regulatory requirements at their own expense and provide proof of compliance. Provisions that require compliance with specific hygiene measures due to the spread of an epidemic or pandemic, beyond the legal requirements, as published in relevant regulations and separate notices, must also be adhered to. In the event of an epidemic or pandemic, the legally required hygiene concept of Perla Venue must be provided.

14. GASTRONOMY / CATERING
​
The caterer must possess the appropriate gastronomy concession and must disclose this to Perla Venue upon contract conclusion. Perla Venue reserves the right to reject catering companies without stating reasons.
15. WASTE DISPOSAL
​
The organizer undertakes to dispose of any waste generated during the event and leave the hall in a broom-clean condition.

16. CONTACT PERSON
The management must designate a responsible person's name who will be available as a contact person to the hallmaster during an event and can be reached at any time.
17.HOUSE RULES
​
The house rules (Attachment ./2) must be observed. The organizer undertakes to base their contractual relationships with third parties on the house rules and to inform other visitors accordingly. Therefore, a copy of the house rules must be posted and made accessible in the entrance area.
18. LOST AND FOUND
​
All items found after the event (jacket, hat, etc.) can be collected from the Perla Venue office up to one month later. The items will be handed over to the lost and found office in Linz.
19. LIABILITY FOR HAND LUGGAGE
​
We do not accept liability for the loss of hand luggage in Perla Venue.

20. PHOTOS AND VIDEOS
​
Please note that photos and/or videos will be taken at the event venue and may be published for the purpose of documenting the event as well as for marketing purposes on the social media platforms of CA Group GmbH – Perla Venue (Google, Facebook, Instagram, TikTok, website).
